Smithian Sentimentalism Anticipated: Pufendorf on the Desire for Esteem and Moral Conduct

In this paper, we argue that Samuel Pufendorf's works on natural law contain a sentimentalist theory of morality that is Smithian in its moral psychology. Pufendorf's account of how ordinary people make moral judgements and come to act sociably is surprisingly similar to Smith's. Both thinkers maintain that the human desire for esteem, manifested by resentment and gratitude, informs people of the content of central moral norms and can motivate them to act accordingly. Finally, we suggest that given Pufendorf's theory of socially imposed moral entities, he has all the resources for a sentimentalist theory of morality.

Do we need earth jurisprudence? Looking for change in new old friends

The article introduces the reader to the theory of Earth Jurisprudence through an analysis of the writings of Thomas Berry, Cormac Cullinan and Peter Burdon. After looking at the main revisions that the scholars of Earth Jurisprudence propose to the theory of law, the article recognizes the fact that they all move in the direction of natural law theories and questions the opportunity to take this path in order to change the relationship between human law and the environment.

In the first three sections of this paper, the author examines the ambiguous usage of legal and moral terminology in the field of neurosciences. The fourth section is devoted to the analysis of the natural law tradition: obviously in this context naturalistic tendencies have been opposed and isolated by the forbiddance derived from the naturalistic fallacy argument. The Dutch humanist Hugo Grotius’ status as an important forerunner of the Enlightenment is well recognized, bolstered by his famous etiamsi daremus-dictum in the Prolegomena of De iure belli ac pacis. Less well known is that Grotius was the first central Protestant thinker to redefine the concept of ius, so that it was understood as individual or subjective rights.
